Land users must pay attention to the renewal period to avoid revocation
According to Article 64 of Decree 102 of 2024, effective from August 1, the renewal of land use must be carried out within the last year of the land use period. Land users must submit their application no later than 6 months before the expiration date. If this deadline is missed, the land will be revoked, except in cases of force majeure.
Land use term according to the Land Law
Specifically, according to Article 172 of the Land Law, the term for allocating land to individuals directly engaged in agricultural production for annual crops, aquaculture, salt-making, perennial crops, and production forests is 50 years. After this period, individuals can continue to use the land as per the regulations without needing to complete renewal procedures.

Land users need to prepare a complete set of documents and submit them to the competent authorities such as the provincial one-stop service, land registration office, or its branches. The documents include:
Procedures and steps for land use renewal
The land use renewal procedure follows the provisions of Clauses 2, 3, 4, and 6 of Article 44 of Decree 102 of 2024. If the land user does not request a new certificate, the land registration office or its branch will confirm the change in land use term on the existing certificate.
Confirmation of agricultural land use term
According to Article 65 of Decree 102, agricultural land users under Article 172 and Article 174 of the Land Law who need to confirm the land use term on the existing certificate should submit a written request according to Form No. 09 along with the existing certificate to the receiving authority. The receiving authority will check and confirm the continued use term on the existing certificate or issue a new one if requested. The time frame for handling these procedures is decided by the provincial People's Committee but should not exceed 7 working days.
Renewal of land use when purchased from enforcement agencies
According to Clause 1, Article 174 of the Land Law, the term for using land when acquiring land use rights is the remaining land use term. The renewal of land use follows the provisions of Clause 3, Article 172. If agricultural land is acquired through enforcement agency decisions, the land user will continue to use the land according to the specified term without needing to complete renewal procedures.
