When you have been residing in the United States for 10 years and wish to return to Vietnam to purchase real estate (BĐS), you need to follow certain procedures and comply with Vietnamese laws. Here are the main steps you need to be aware of:

1. Determine Legal Status

  • If you are a Vietnamese citizen (still holding Vietnamese nationality), you can purchase real estate like any ordinary Vietnamese citizen.
  • If you have obtained U.S. citizenship or are an overseas Vietnamese with foreign nationality, you can purchase real estate in Vietnam but with certain restrictions. Specifically, you can only buy commercial housing, not exceeding 30% of the units in a single apartment building, or not exceeding 10% of the houses in a land project.

2. Prepare Documents

  • Proof of Vietnamese Origin: If you are an overseas Vietnamese, you need to provide documents proving that you or your parents, grandparents are of Vietnamese origin.
  • Personal Documents: Passport, land use rights certificate (if applicable), and other relevant documents.

3. Real Estate Purchase Procedure

  • Sign a Purchase Agreement: You will need to sign a purchase agreement with the seller or developer, and this agreement must be notarized.
  • Pay Taxes and Fees: You must pay various taxes such as registration tax, personal income tax (if you resell the property), and registration fees.
  • Register Ownership: After full payment, you need to register your property ownership at the Land Registration Office of the province or district where the property is located.

4. Special Regulations

  • Regulation on Usage Term: If you are purchasing land, be aware of the land use term under Vietnamese law, typically 50 years for foreigners or overseas Vietnamese.
  • Ownership Restrictions: Foreigners and overseas Vietnamese are limited to owning a maximum of 30% of the units in a single apartment building and a maximum of 10% of the houses in an urban development area.
