According to Article 3 of the 2024 Land Law, land use fees refer to the amount that land users must pay to the state in cases where the state allocates land with a fee, when land use purposes change, or when the state recognizes the land use rights (such as issuing red or pink books for land that is not granted or leased by the state).

Specific regulations on land use fee payments are outlined in Article 55 of the 2019 Tax Management Law and Decree 126/2020/ND-CP. These include:

  • Within 30 days from the date of the issued notice, the land user must pay 50% of the amount specified in the notice.
  • Within 90 days of the notice, the remaining 50% must be paid.
  • In special cases, such as reassessment of land use fees, the land user must pay 100% of the land use fee within 30 days from the date of notification.

These regulations aim to ensure smooth land transactions while allowing the state to collect land use fees to support economic and social development.

How to Calculate Late Payment Fees

One of the significant issues when failing to pay land use fees on time is the calculation of late payment fees. According to Article 59 of the 2019 Tax Management Law, if the land user fails to pay on time, the tax authority will calculate the late payment fee at a rate of 0.03% per day. This rate is based on the unpaid amount and the number of overdue days.

  • Late payment fee for 1 day = 0.03% × Unpaid amount
  • Total late payment fee = (0.03% × Unpaid amount) × Number of overdue days

For example, if the land use fee is 100 million VND and payment is delayed by 30 days, the late payment fee will be:

  • Daily late payment fee = 0.03% × 100 million VND = 30,000 VND
  • Total late payment fee for 30 days = 30,000 VND × 30 = 900,000 VND

Therefore, failing to pay on time can result in additional costs that may exceed one’s financial capacity, especially if they have not planned or prepared for it in advance.

Long-Term Effects of Failing to Pay on Time

Not only does failing to pay land use fees result in immediate financial losses, but it can also lead to long-term legal consequences for individuals. One of the most serious consequences is the inability to obtain the land’s red book (or pink book) if the land use fees are not fully paid.
