Through the Government’s Online Information Portal, Ms. Đặng Thị Nga raised a question: she has a labor contract in Hanoi, does not own any real estate, and has an average monthly income of under 40 million VND. Her family is currently renting a mini apartment but has not been able to register temporary residence because the landlord has not provided the land-use certificate (red book) required for the procedure.
Ms. Nga is concerned whether, in cases where a person already has a labor contract in the locality where a social housing project is located, it is mandatory to have temporary residence registration when submitting an application to purchase social housing.
Removing mandatory temporary residence requirements in social housing application procedures
In addition, during the process of preparing her application documents, the applicant noted that proof of social insurance contributions and a certificate of housing eligibility are required. She questioned whether these documents are still necessary in the context where many personal data fields have already been integrated into digital platforms, and also expressed a desire to understand her family’s chances of owning social housing.
In response, the Ministry of Construction stated that current laws only stipulate conditions for purchasing or leasing social housing based on housing need and income, and do not include residency requirements.
According to the Ministry of Construction, application dossiers and the competent authorities’ determination of eligible beneficiaries as well as housing and income conditions are specified in Articles 76 and 78 of the 2023 Housing Law; Articles 29 and 30 of Decree No. 100/2024/ND-CP dated July 26, 2024 on the development and management of social housing, as amended and supplemented by Decrees No. 261/2025/ND-CP, 54/2026/ND-CP, and 136/2026/ND-CP.
Documents proving eligibility and conditions for social housing support policies are specified in Articles 6, 7, and 8 and Appendix I of Circular No. 05/2024/TT-BXD of the Ministry of Construction, as amended and supplemented by Circulars No. 32/2025/TT-BXD and 08/2026/TT-BXD.
To obtain information on social housing projects in Hanoi, the Ministry of Construction recommends that Ms. Nga visit the electronic information portal of the Hanoi Department of Construction, the local People’s Committee at the commune level where the project is located, or the developer’s website or real estate trading platform (if available) in order to prepare her application for social housing registration.
