New Regulations on Agricultural Land Use in Ho Chi Minh City

The Ho Chi Minh City People's Committee recently issued new regulations regarding the use of agricultural land for constructing structures that directly serve agricultural production. This regulation applies to agricultural land plots that have been granted land use certificates (red book) and are still within their validity period, with a minimum required area of 500 square meters. The regulation aims to ensure that agricultural land is managed and used effectively and sustainably while creating opportunities for farmers and production units to invest in infrastructure, enhancing productivity and promoting sustainable agricultural economic development.

For land plots that meet the area requirements, the Ho Chi Minh City People's Committee allows the construction of agricultural production facilities, limiting the building area to no more than 1% of the total land area and not exceeding 50 square meters. This means that even if landowners have a large area, they must strictly adhere to the building area regulations to prevent significant encroachment on cultivated land. This measure is crucial for balancing infrastructure development for production with preserving arable land. The regulation reflects the urgency of protecting agricultural land resources, avoiding non-agricultural misuse, and optimizing land usage to safeguard food security and a sustainable ecosystem in the city.

The structures are allowed to be only one story, with a maximum roof height of 5 meters, and no basements are permitted. This regulation ensures that the structures do not significantly alter the rural landscape and are consistent with the intended agricultural use of the land. Limiting the height of the structures aims to preserve the natural landscape, ensuring the integration of constructed facilities with the existing agricultural space. This also helps maintain ecological integrity, protecting biodiversity and avoiding disruption to the natural balance within farming areas.

In terms of structural requirements, these facilities must be semi-permanent, using materials like brick walls or lightweight materials, with columns that may be made of brick, steel, or iron, and roofs made from lightweight materials. Using these materials not only helps reduce construction costs but also ensures flexibility for the structures. Lightweight materials allow for easy dismantling or adjustment when needed, suitable for the temporary nature and changing needs of agricultural production. This flexibility benefits farmers by reducing investment costs and enabling modifications to adapt to production conditions, optimizing land use efficiency.

Additionally, this regulation facilitates the construction of essential infrastructure such as warehouses, equipment storage, or agricultural product preservation facilities. These structures play a vital role in preserving and enhancing product quality, reducing post-harvest losses. With secure storage facilities, agricultural products are better protected from elements like harsh weather, pests, and mold, thus increasing product value, raising farmer income, and enhancing value added to the agricultural production chain.

The issuance of this regulation by the Ho Chi Minh City People's Committee demonstrates a strong commitment to protecting and developing agricultural land resources. At the same time, the regulation provides favorable conditions for farmers and agricultural organizations to invest in the necessary facilities to enhance production activities. This is an important step towards rationalizing land use, ensuring stability and sustainability in agricultural land usage, and preventing illegal or inefficient land use. However, the requirements on building area and structure pose certain challenges for residents, necessitating careful calculations and planning to meet production needs while complying with the regulations. This requires farmers to have a clear strategy in land use and facility design, making the most of available space for maximum efficiency.

Technical support programs, recommendations on material selection, and guidance on legal procedures will help alleviate difficulties residents may face in the implementation process. Timely and effective support from the government not only optimizes production activities but also contributes to protecting and maintaining agricultural land resources, ensuring the sustainable development of urban agriculture. Successfully implementing this regulation will make a significant contribution to sustainable agricultural development, improving productivity and product quality, while also ensuring food security for the city amidst rapid urbanization.
